Please be aware that possessing, selling, manufacturing, or delivering a forged, stolen, fictitious or unlawfully issued driver’s license or identification card is a crime. Offering to sell, manufacture, or deliver one is also a crime. Consequences for committing these crimes may include arrest and monetary fines. Be original, not a fake!
Section 322.212, F.S., Unauthorized possession of, and other unlawful acts in relation to, driver’s license or identification card, defines state provisions related to the illegal use of driver’s licenses and identification cards (IDs) and codifies penalties associated with the violation of these provisions. The penalties delineated within the statute are severe and can have lasting negative effects on those who face them.
Please be aware that under FSS 322.212, it is unlawful for any person to:
• Knowingly have in his or her possession or to display any blank, forged, stolen, fictitious, counterfeit, or unlawfully issued driver license or identification card;
• Knowingly have in his or her possession any instrument in the similitude of a driver license, or other license recognized in this state for the operation of a motor vehicle;
• Knowingly have in his or her possession any instrument in the similitude of an identification card, or other identification card recognized in this state for the purpose of indicating a person’s true name and age;
• Knowingly sell, manufacture, or deliver, or knowingly offer to sell, manufacture, or deliver, a blank, forged, stolen, fictitious, counterfeit, or unlawfully issued driver license or identification card;
• It is unlawful for any person to barter, trade, sell, or give away any driver license or identification card or to perpetrate a conspiracy to barter, trade, sell, or give away any such license or identification card;
Any person found to be violating the above subsections of FSS 322.212 is guilty of a felony of the third degree and may face the following consequences:
• A term of imprisonment of up to five (5) years;
• $5,000 fine;
• Attorney’s fees and costs
•Court costs;
